User Agreement and Community Standards
Please read these Terms of Service carefully. By creating an account or accessing Nova, you agree to be bound by all of the rules, conditions, and liability disclaimers contained herein. If you do not agree to these terms, you are strictly prohibited from using the application.
These Terms of Service (the "Terms" or "Agreement") constitute a legally binding agreement made between you ("you", "your", or "user") and Nova ("we", "us", "our", or "Nova"), concerning your access to and use of the Nova mobile application, website, and any other related services (collectively, the "Service"). By registering an account, viewing content, or utilizing any features on Nova, you acknowledge that you have read, understood, and agreed to be bound by the entirety of this Agreement.
The Service is designed and intended exclusively for adults. You must be at least eighteen (18) years of age to access or use the Service. By creating an account or interacting on Nova, you represent and warrant that you are at least 18 years of age and have the full legal capacity to enter into this contract. If you are under 18, you must immediately uninstall Nova and cease all usage. We reserve the right to demand age verification documents from any user at any time.
To preserve community safety, eliminate fraudulent entities, and prevent impersonation, any user wishing to become a "Creator" on Nova must complete our mandatory identity verification process. This requires providing valid government-issued photographic identification and passing a biometric liveness verification check. Creators are solely responsible for ensuring the information submitted during verification is accurate, truthful, and updated. Failure to pass verification will result in the restriction of account privileges.
When you register for an account, you agree to provide complete, accurate, and current profile information. You are entirely responsible for maintaining the strict confidentiality of your account password and for all activities that occur under your username. You must notify us immediately at service@nova.camera if you suspect any unauthorized access or breach of security. We will not be liable for any loss or damage arising from your failure to protect your login credentials.
You retain full ownership and intellectual property rights in any text, photos, video, audio, designs, or other content you upload or publish to Nova ("UGC"). However, by submitting UGC to the Service, you grant Nova a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, copy, display, distribute, modify, and run your UGC for the sole purpose of operating, maintaining, and promoting the Service. You represent and warrant that you possess all necessary rights and clearances to grant this license without infringing upon third-party copyrights or privacy rights.
Nova is a respectful and creative community. You agree not to upload, transmit, or promote content that:
Zero Tolerance & Immediate Termination: We maintain a strict zero-tolerance policy. Any user discovered to be in violation of these content rules will have their account permanently banned upon discovery without prior notice, refunds, or recourse.
Except for your User-Generated Content, all components of the Service—including the application codebase, user interfaces, branding, logos, website layout, graphics, database designs, and custom software—are owned by or licensed to Nova and are protected by international copyright, trademark, and trade secret laws. You may not copy, reverse-engineer, distribute, modify, or exploit our intellectual property without our express prior written authorization.
Nova provides tools that allow creators to gain support and generate earnings through creative activities and interactions. The operational structures, distribution fees, payout criteria, and supported transaction methods on the platform are governed by our separate Platform Monetization Rules, which may be modified, suspended, or discontinued at any time at Nova's sole discretion to ensure regulatory compliance or system optimization.
Users may choose to support creators by subscribing to their profiles or purchasing digital access keys. All purchases and financial transactions processed on Nova are handled by integrated third-party secure billing systems (such as Apple App Store In-App Purchases, Google Play Billing, or standard card processors). All transactions are final, and refunds are strictly subject to the refund policies of the respective app stores or payment facilitators, unless otherwise required by local statutory laws.
We respect the intellectual property of others. If you believe that any content hosted on Nova infringes upon your copyright, please submit a formal Digital Millennium Copyright Act (DMCA) notice to our designated Copyright Agent at service@nova.camera. Your notice must include: a physical/electronic signature of the copyright owner; identification of the copyrighted work claimed to be infringed; details of the infringing material; your contact details; a statement of good faith; and a statement under penalty of perjury that the information is accurate.
To use Nova, you require a compatible smartphone or mobile device with reliable internet connectivity. You are solely responsible for obtaining and maintaining all devices, hardware, and mobile network services necessary to access Nova, and for paying all associated carrier fees, data usage charges, and text messaging tariffs incurred during your use of the Service.
We reserve the absolute right, without liability or prior notice, to suspend, restrict, or permanently terminate your account and block your access to Nova for any reason, including but not limited to: a breach of these Terms, non-use, fraudulent activities, security threats, or behavior detrimental to other community members. Upon termination, all rights granted to you under this Agreement will cease immediately, and you must cease using the Service.
THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, SECURITY, AND NON-INFRINGEMENT. WE MAKE NO GUARANTEES THAT THE SERVICE WILL BE UNINTERRUPTED, COMPLETELY SECURE, SECURE FROM BUGS OR ERRORS, OR FREE OF VIRUSES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOVA, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF GOODWILL ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to defend, indemnify, and hold harmless Nova, our subsidiaries, affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with: your misuse of the Service; your User-Generated Content; your violation of these Terms; or your infringement of any rights of another person or legal entity.
These Terms of Service and your relationship with Nova shall be governed by and construed in accordance with the laws of the jurisdiction in which our corporate entity is registered, without regard to conflict of law principles. Any legal dispute, action, or proceeding arising out of this Agreement shall be brought exclusively in the competent courts of that jurisdiction, and you hereby consent to the personal jurisdiction and venue of such courts.
If any provision or portion of these Terms is determined to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions, which shall continue in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
We reserve the right, at our sole discretion, to modify, update, or replace any part of these Terms at any time. If changes are substantial, we will notify users through in-app alerts or email notifications. Your continued use of Nova following the posting of any updates constitutes your explicit and legally binding acceptance of the modified Terms of Service.
